Record interviews in compliance with the GDPR
Not a fundamentally new topic
Audio or video recordings have been one of the central data forms of qualitative research for decades. The topics of data protection and confidentiality have always been considered in the literature, albeit often with varying degrees of detail. The most recent publications that take a closer look at the topic can be found in Schaar (2017), Liebing et.al. (2014) and Gebel et.al. (2015)were therefore created well before the General Data Protection Regulation (GDPR) came into force.
Even at this time, there were already significant information and documentation obligations, some of which are addressed in the publications. Through Art. 5 para. 2 GDPR, controllers will in future be obliged to be able to prove at any time that they comply with data protection requirements (accountability). In order to provide this evidence, it is necessary to expand the documentation of existing processes. In addition, the rights of data subjects, which have been further strengthened by the GDPR, must be taken into account. To date, we are not aware of any guidelines that refer to the current requirements of the GDPR.

In cooperation with Dr. Karsten Krupna from the law firm Krupna Legal, we have created a MODEL declaration of consent. Consent is not required for all surveys. (In addition to consent, there are also other possibilities for data processing, e.g. in accordance with § 27 of the Federal Data Protection Act (BSDG), to which we do not refer here).
